ORDER

This petition has been filed to modify the condition in para No.7(b) imposed on the petitioner in Crl.O.P.No.9027 of 2025, dated 26.03.2025, that the petitioner shall report before the respondent police everyday at 10:30 a.m., until further orders.

The learned counsel appearing for the petitioner submitted that the petitioner was arrayed as an accused in another Crime No.358 of 2024 on the file of PEW, R.K. Pet Police Station and the petitioner was granted bail in the above crime number by the Principal Special Judge, Principal Special Court under EC& NDPS Act, Chennai, vide order dated 09.05.2025 in Crl.M.P.No.2293 of 2025 with one of the condition that the petitioner shall appear before the respondent police daily at 10:30 a.m., for a period of 15 days. He further submitted that the petitioner came out on bail only on 06.06.2025 after furnishing sureties and execution of bond as per the order dated 09.05.2025 in Crl.M.P.No.2293 of 2025 and he is also complying with the condition imposed on him in that case, hence he is unable to comply with the condition imposed on him by this Court, vide order dated 26.03.2025 in Crl.O.P.No.9027 of 2025. Therefore, sought for modification of the condition in para No.7(b) imposed on the petitioner in Crl.O.P.No.9027 of 2025, dated 26.03.2025.

The learned Government Advocate (Crl.Side) appearing for the respondent raised strong objection by stating that the petitioner has not complied with the condition even once.

Considering the submissions of both sides, the fact that the petitioner was arrested in another crime number and subsequently, released on bail and complying with the condition imposed on him thereon in that case, this Court is inclined to modify the condition in para No.7(b) imposed on the petitioner in Crl.O.P.No.9027 of 2025, dated 26.03.2025 to the effect that the petitioner shall report before the respondent police everyday at 10:30 a.m., for a period of 15 days, starting from the date of receipt of copy of this order and thereafter, the petitioner shall appear before the Trial Court on all hearing dates without fail.
