Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, for issuance of a writ of mandamus directing the respondent to modify the order of the respondent dated 31.07.2009 by directing the respondent Bank to make payments to the staff (teaching and non-teaching) of the Kongunadu College of Engineering and Technology, Kongunadu Polytechnic College, Kongunadu College of Education and staff of Kongunadu Educational Charitable Trust (as per the list of staff with details of salary submitted to the respondent Bank) towards their salary every month form the 18 current accounts held by the petitioner and its institutions in the Indian Bank, Namakkal Branch, Namakkal District and Meikkalnaickenpatti Branch. Thottiam Taluk, Trichy District till the dispute between the members of the petitioner Trust referred above are resolved. O R D E R

The instant writ petitioner is seeking for a writ of Mandamus directing the respondent to modify the order of the respondent dated 31.07.2009 by directing the respondent Bank to make payments to the staff (teaching and non-teaching) of the Kongunadu College of Engineering and Technology, Kongunadu Polytechnic College, Kongunadu College of Education and staff of Kongunadu Educational Charitable Trust (as per the list of staff with details of salary submitted to the respondent Bank) towards their salary every month form the 18 current accounts held by the petitioner and its institutions in the Indian Bank, Namakkal Branch, Namakkal District and Meikkalnaickenpatti Branch. Thottiam Taluk, Trichy District till the dispute between the members of the petitioner Trust referred above are resolved.

2. Mr.K.Sathish, learned counsel appearing for the petitioner submits that, he has got instructions not to proceed the writ petition and therefore, he has sought to withdraw the writ petition.

3. The endorsement of the learned counsel has been taken on the case bundle. In view of the submission of learned counsel for the petitioner, this writ petition is dismissed as withdrawn. There shall be no order as to costs. Consequently, the connected miscellaneous petition is also closed.
