These petitions have been filed;

(a) to condone the delay of 3128 days in filing the petition to set aside the abatement caused by the death of the 1st respondent; (b)to set aside the abatement caused by the death of the 1st respondent and;

(c) to bring on record the legal representatives of the deceased 1st respondent.

2. Being satisfied with the reasons stated in the affidavits filed in support of the above petitions, these Civil Miscellaneous Petitions are allowed.

3. Learned counsel for the appellant shall serve the papers to the learned counsel representing for Mr.Jeremiah, learned counsel for the respondent(s) by tomorrow.
