This Criminal Original Petition has been filed seeking direction to direct the second respondent to execute non-bailable warrant issued by the learned Metropolitan Magistrate, Fast Track Court No.II,Egmore at Allikulam, Chennai-3 in C.C.Nos.4275 & 4286 of 2013 against the accused.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondentPolice and perused the materials available on record.
3. When the matter came up for hearing on 19.06.2025, the learned Government Advocate (Crl.Side) appearing for the respondent -Police Submitted that the respondent -Police had already taken steps to execute the warrant and the respondent-Police had visited the address mentioned in the warrant but, they were unable to execute the same, since the accused was bedridden. However, the learned counsel for the petitioner submitted that the accused had recovered from his ailment and
he was in healthy condition. Consequently, this Court instructed the petitioner to co-operate with the respondent -Police to identify the accused. Today, when the matter is taken up for hearing, the learned Counsel for the petitioner confirmed that the accused is indeed bedridden.
4. In view of the same, the Criminal Original Petitions are dismissed. However, the petitioner is at liberty to workout his remedy before the trial Court in the manner known to law. 23.06.2025 mfa Index:Yes/No Speaking Order: Yes/No
