Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st and 2nd respondents to consider petitioner's representation dated 15.07.2019, within the time fixed by this Hon'ble Court and consequently direct them to change her department from B.E. Electronics and Instrumentation Engineering (E&I) to Electrical and Electronics Engineering and permit her to continue her studies.

Heard the learned counsel for the petitioner and the learned Standing counsel appearing for the Annamalai University.

2. The case of the petitioner is that she joined the respondent University in B.E. Electronics and Instrumentation Engineering (E&I) in the year 2018. Her predicament being a lone female student in the whole class, she is left lonely and not able to cope up. Therefore, sought for change of branch B.E. (E&I) Engineering to B.E.(EEE). She has successfully completed her first year, which was common to all the branches. When she requested the University to change the branch, they also initially accepted the request and issued identity card as B.E. (EEE) student. But later, she is restrained from attending second year class in B.E.(EEE) branch.

In the counter filed by the first respondent University, it is stated that the petitioner cannot change the branch in the second year since the cut off marks for each branch differs and further the score which the petitioner secured is not eligible to get a seat in the B.E.(EEE) branch during the year 2018. Hence, as a the lateral entry in the second year she cannot shift from B.E.(E&I) engineering branch to B.E.(EEE) engineering branch. Further, the learned counsel for the Annamalai University also apprehend that shifting of branch in the second year will lead to crisscross change between the branches during the subsequent year and lead to unrest.

The contention of the learned counsel for the respondent is well found that a candidate who has chosen and allotted a particular branch in the engineering course can not change the branch at a later stage, if the candidate is not otherwise eligible to get the said branch at the time of admission. However, in this particular case, there is a specific discomfort expressed by the female candidate, which makes difficult for her to continue the study in a particular branch B.E.(E&I). Further, when the learned counsel for the University also admits that there are vacancies in the second year B.E.(EEE) course. The request of the petitioner shall be considered by the 1st respondent University, since no one will be prejudiced if the petitioner is permitted to change the branch. Taking note of the peculiar facts and circumstances, the 1st respondent University shall pass appropriate orders as a special case and it shall not be taken as a precedent in future.

5. With the above directions, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
