The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(B), 316(2), 318(2) of BNS Act, on the file of the respondent Police, seeks anticipatory bail.

2. When the matter was taken up for hearing, the learned Government 1/4

Advocate (Crl. Side) submitted that based on the complaint lodged by the defacto complainant, current paper enquiry is pending.

In reply, Mr.Uday Kumar, learned counsel appearing for the defacto complainant submitted that the petitioner has committed the offence of cheating and misappropriation and the allegation is that he had taken flat for rent and thereafter collected huge sums of money of about Rs.14,00,000/- from the defacto complainant as though he is the owner of the flat and thereafter, on enquiry, it was found that the petitioner has taken rent for R.50,000/-. He further submitted that, if the petitioner absconds, the defacto complainant would be in trouble and he would not able to get back his money of Rs.14,00,000/-. He also submits that the current paper status is pending for more than six months.

4. In view of the above, this Court directs the Assistant Commissioner of Police, Thuraipakkam shall take up the current paper and shall dispose of the same within a period of three weeks from the date of receipt of copy of the order.
