ORDER

The petitioner apprehends arrest for the alleged offence under Sections 4(1)(C) of the Tamilnadu Prohibition (Amendment) Act, 2024, 132 & 351(2) of BNS, 2023 in Crime No.72 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that based on secret information, the respondent police conducted surveillance near a public toilet and found two

gunny bags containing 40 bottles (180ml) of Black Pearl Brandy and 40 bottles (180ml) of Express Special Brandy. Hence, the case was registered.

3. The learned counsel appearing for the petitioner would submit that the petitioner was never present at the place of occurrence and the allegations contained in the FIR are false and fabricated. It is further submitted that the petitioner is suffering from certain health issues. Therefore, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would strongly oppose the application on the ground that the petitioner has two previous cases of similar nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that this Court was inclined to dismiss the application considering the past conduct of the petitioner. At this juncture, the learned counsel relied upon a medical certificate dated 15.04.2026. However, the alleged occurrence had taken place subsequent to the said medical condition. Therefore, the medical condition relied upon by the petitioner does not in any manner help his case. Considering the past conduct of the petitioner and the

possibility of repetition of similar offences, this Court is not inclined to grant anticipatory bail.
