ORDER
The petitioner apprehends arrest for the alleged offences under Sections 332(b), 64 of BNS Act, 2023 and r/w 92(b) of the rights of persons with Disabilities Act, 2016 in Crime No.18 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the accused persons allegedly had sexual intercourse with the victim, a mentally challenged girl aged about 18 years, while she was alone at home, resulting in her pregnancy. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner, aged 52 years is suffering from elephant leg disease and jaundice and he was taking treatment in Andhrapradesh since the year 2023. Hence, he prayed to grant anticipatory bail to the petitioner.

Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the victim girl, aged about 18 years and a mentally challenged person, became pregnant due to the alleged sexual assault committed by the accused persons. He further submitted that there are two accused in this case and the petitioner is arrayed as A2, and the specific allegations have been made against him in the FIR. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to either side submissions.
6. Considering the seriousness of the offence and the specific allegations attributed against the petitioner, this Court is of the view that custodial
interrogation of the petitioner is necessary. Hence, this Court is not inclined to enlarge him on anticipatory bail.
