ORDER

The petitioner apprehends arrest for the alleged offence under Sections 5(I), 5(j)(ii) and 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 in Crime No.66 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the victim is a minor and that she and the accused fell in love with each other. Under the false pretense that engaging in sexual intercourse would prevent anyone from separating them and with a promise of marriage, the accused committed aggravated penetrative sexual assault on her, resulting in a four-month pregnancy.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and upon instructions, submitted that statement under Section 183 of the B.N.S.S. is yet to be recorded and investigation is still pending. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Considering the facts and circumstances of the case and also taking note of the submissions made by the learned counsel on both sides that statement under Section 183 of the B.N.S.S is yet to be recorded and investigation is still pending. Taking into consideration the factual position, it is too premature to consider the anticipatory bail application of the petitioner. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
