ORDER
The petitioner apprehends arrest for the alleged offence under Sections 8(c) r/w 20(b)(ii)(B), 25 of NDPS Act, 132 and 351(3) of BNS, 2023 in Crime No.538 of 2024 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the accused persons were found in possession of 1 kgs and 200 grams of Ganja. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal side) strongly objected to grant anticipatory bail to the petitioner on the ground that the accused persons were found in possession of 1 kgs and 200 grams of Ganja.
5. From the submissions of the learned counsel on either side and considering the facts and circumstances of the case and taking note of the nature of the allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
