Respondents Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus to call for the records of the respondents in connection with the impugned order issued by the second respondent in Rc.No.2332/2019/A1, dated 21.12.2019 and quash the same and further direct the respondents to reinstate the petitioner into service with all consequential and monetary benefits.

ORDER

This Writ Petition has been filed challenging the impugned suspension order, dated 21.12.2019. Till date, no counter affidavit is filed by the respondents. Learned counsel for the petitioner now submitted that the petitioner will be satisfied if a direction is issued to the respondents to consider the petitioner's representation seeking for revocation of the suspension order, in the light of G.O.(Ms).No.81, Human Resources Management (N) Department, dated 04.08.2022. No prejudice would be caused to the respondents, if such a direction is issued to the respondents. Hence, this Court directs the petitioner to submit a fresh representation to the second respondent, requesting for revocation of suspension order passed against him, within a period of two weeks from the date of receipt of a copy of this order.

Upon receipt of such representation, the second respondent shall pass final orders on the said representation on merits and in accordance with law and also in the light of the said G.O.(Ms).No.81, within a period of four weeks thereafter. With these observations and directions, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, the miscellaneous petitions are closed. 09.11.
