CMP No. 1435 of 2024 in CMA No. 3208 of 2010 T.V.THAMILSELVI, J.

This petition has been filed to modify the order made in CMA No. 3208 of 2010 dated 31.03.2021.

2. The learned counsel for the petitioner submits that as per the order of the Hon'ble Supreme court made in Civil Appeal No. 1265-1266 @ SLP9C No. 1267 of 2019 Union of India Vs. Radha Yadav order dated 29.01.2019 the applicant/claimants are entitled for Rs.4,00,000/- along with reasonable interest or Rs.8,00,000/- whichever is higher.

3. Considering the above, Para No. 15 of this Court order dated 31.03.2021 in CMA No. 3208 of 2019 is modified as follows:

15. Accordingly, the Civil miscellaneous appeal is dismissed. The respondent/Railway is directed to deposit the award amount of Rs.8,00,000/-(Rupees Eight Lakh Only) within a period of 12 weeks from the date of receipt of a copy of the judgment. Consequently connected miscellaneous petition is closed. No costs.

4. Accordingly, this petition is ordered.
