The petitioner, who was arrested and remanded to judicial custody on 04.07.2022 for the offences punishable under Sections 4(1)(a) read with Section 4(1-A) of Tamil Nadu Prohibition Act and Section 328 of I.P.C and Section 20(1) of Cigarette and other Tobacco Products Act, 2003 in Crime No.354 of 2022, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 142.14 kgs of banned tobacco products and 8640 ml liquor bottles in a vehicle bearing Reg.No.TN 42 P 6872. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and a false case has been lodged against the petitioner. Hence, he prayed for grant of bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Additional Public Prosecutor submitted that are totally 8 accused and the petitioner is arrayed as A1 and the other 7 accused in this case are still absconding. Hence, he opposed for grant of bail to the petitioner.

5. Considering the quantity of the alleged contraband seized from the accused and also considering that other accused are yet to be secured, this Court is not inclined to grant bail to the petitioner.
