Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 3rd and 5th Respondents to consider the representation of the Petitioner dated 17.10.2024 and to remove the encroachment put up in the National Highway 38, Opposite to the Government College and Hospital at Tiruvanamalai, For Petitioner :

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) In a quick response to the allegation made in the petition, learned State counsel has come out with a status affidavit, which shows that on taking cognizance of the complaint regarding temporary construction having been raised alongside the national highway, notices have been issued to the encroachers and appropriate action would be taken.

2. We are surprised to see that as many as 34 persons have been found to be encroachers and notices have been issued.

3. The notices should be brought to its logical conclusion one way or other, soon after the receipt of reply to the notices by the alleged encroachers. More than once, further opportunity of filing reply shall not be granted. After the reply is submitted, decision shall have to be taken within two months. All encroachments, which are found alongside the national highway, should be removed at the earliest.
