The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 7 (1) & 7 (3) of Lotteries Regulation Act, 1998, in Crime No.145 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that petitioner is implicated in this case on the basis of the confessional statement of the co-accused. He is innocent and falsely implicated in Crime No.145 of 2023, for the alleged offence under Sections 7 (1) & 7 (3) of Lotteries Regulation Act, 1998. Thus, he seeks for grant of anticipatory bail for the petitioner.

3.In response, the learned Government Advocate (Crl.side) submitted that on 11.06.2023, at about 10.a.m., when the police party were in their patrol duty near Esanur bus stop, they found two persons under suspicious circumstances. On seeing the police, they tried to escape, but the police apprehended Sathish. They came to know that the

petitioner is the one who escaped from the scene of occurrence. Police recovered the lottery tickets from the first accused. It is further submitted that the petitioner has similar cases pending against him. 4.Considering the fact that the petitioner has similar cases pending against him and that investigation is not completed, this Court is not inclined to grant anticipatory bail to the petitioner. 5.Accordingly, this Criminal Original petition is dismissed. 26.07.2023 sli
