PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for entire records pertaining to issuance of the order dated 29.5.2018 passed by the 5th respondent namely the Chairman, Taxation Appeals Tribunal, Greater Chennai Corporation, Ripon Buildings, Chennai-3 in T.A.T.No.33 of 2017, quash the same and consequentially direct respondents 1 to 4 to assess the property of the petitioner at No.161, Karuneegar Street, Adambakkam, Chennai-88 as per the guidelines prescribed by the Corporation of Chennai.

ORDER

Mr.T.C.Gopalakrishnan, learned Standing Counsel accepts notice for the respondents. Heard both.

2.Mr.T.C.Gopalakrishnan, learned Standing Counsel appearing for the respondents submits that as against the impugned order, an appeal lies to the Principal Judge, City Civil Court, Chennai in terms of Part V Rule 15 of the Chennai City Municipal Corporation Act.

3.The learned counsel for the petitioner submits that time may be granted to the petitioner to move the Appellate Court.

4.Accordingly, the writ petition is disposed of and the petitioner is granted ten days' time from the date of receipt of a copy of this order to prefer the appeal. In the meantime, the respondent Corporation shall not take any coercive action against the petitioner. No costs. Consequently, the connected WMP is closed.
