The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379, 430 of IPC and Section 21(1) of TNMMDR Act in Crime No.161 of 2022, on the file of the respondent police, seeks anticipatory bail. 2.It is the case of the prosecution that the petitioner is alleged to have transported one unit of sand without any valid license. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor submitted that this Court dismissed the petitioner's earlier anticipatory bail petition vide order dated 27.06.2022 in Crl.OP.No.14693 of 2022 on the ground that there are three previous case pending against the petitioner. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that there is no change of circumstances, after the dismissal of the petitioner's earlier anticipatory bail petition. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 17.08.2022 vv 2/3
