The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 379 & 430 IPC, in Crime No.266 of 2023, on the file of the respondent police, seeks anticipatory bail.

2.It is the submission of the learned counsel for the petitioner that petitioner is an innocent person and he has been falsely implicated in this case. Thus, he seeks grant of anticipatory bail for the petitioner. 3.In response, the learned Government Advocate (Crl.Side) opposed this petition and submitted that on 17.06.2023, at about 03.00 a.m., when the respondent police were in routine vehicle check up near Agraavaram, accused in this case had illegally transported one unit of river sand, in a Mini Tipper, bearing registration No.TN 01 K 8975, without any valid permit. On seeing the respondent police, driver of the vehicle escaped from the scene of occurrence. Vehicle and sand had been recovered. He further submitted that petitioner has one previous

case pending against him.

4.Considering the fact that petitioner had involved in illegal transportation of river sand and that the river sand stolen is one unit and the fact that petitioner has one previous case pending against him and that investigation in this case is not completed, this Court is not inclined to grant anticipatory bail to the petitioner. Therefore, this Criminal Original Petition is dismissed.
