Nos.591 & 592 of 2009, 698 of 2013 & 117 of 2022 P.B.BALAJI, J., Mr.Abdul Mubeen, the learned counsel was appointed as Advocate Commissioner, vide order dated 09.02.2023. As per the direction of this Court, he has proceeded to carry out the preliminary inspection. The plaintiffs and the Administratrix have serious reservations about the Advocate Commissioner. The Advocate Commissioner has also filed a memo before this Court seeking permission to withdraw from the appointment, pursuant to the warrant dated 09.02.2023. In order to avoid any further embarrassment to the Advocate Commissioner, the memo is taken on file and the order appointing, Mr.Abdul Mubeen, as the Advocate Commissioner is recalled.
2. Mr.S.Vasudevan, learned counsel having office at "Mangala Jyothi" No.43, S-10, 4 Trust Cross Street, Mandavelipakkam, Chennai - 600 028, (Ph:98842 89896), is appointed as Advocate Commissioner to proceed with the inspection, after giving notice to the interested learned counsel. His initial remuneration is fixed at Rs.1,00,000/-, the amount shall be paid by the plaintiffs. In view of the above, the earlier warrant issued to https://www.mhc.tn.gov.in/judis
Mr.Abdul Mubeen, learned counsel shall be re-issued to the newly appointed Advocate Commissioner, Mr.S.Vasudevan. In the meantime, the Administratrix shall file a statement of accounts as on 31.03.2024, to enable the plaintiffs to take out/pursued other applications seeking permission to operate the account lying with DBS Bank, disbursement of funds, etc.,
