Writ Petition filed under Article 226 of the Constitution of India for issuing a Writ of Mandamus directing the 3rd respondent to pass orders on the petitioner's Fundamental Objection dated 02.11.2020 filed in Appeal File No.Na.Ka.I1/5032/2020, as preliminary issue for mis-joinder of unconnected persons, who were not parties to the proceedings of the 4th respondent in Na.Ka.I1/855/2020 by order dated 07.102020 and other vital grounds in accordance with law. The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the 3rd respondent to pass orders on the petitioner's Fundamental Objection dated 02.11.2020 filed in Appeal File No.Na.Ka.I1/5032/2020, as preliminary issue for mis-joinder of unconnected persons, who were not parties to the proceedings of the 4th respondent in Na.Ka.I1/855/2020 by order dated 07.102020 and other vital grounds in accordance with law.
2. Ms. K. Aswini Devi, learned counsel appearing for the petitioner submitted that the petitioner has given an objection dated 02.11.2020 to the 3rd respondent to decide the issues therein as preliminary issues.
3. Ms. A. Madhumathi, learned Special Government Pleader appearing for the respondents 1 to 14 submitted that she has got instructions to the effect that the 3rd respondent had received the objections dated 02.11.2020 from the petitioner and that the same would be considered as preliminary issues when the Appeal is taken up for hearing on 16.12.2020.
4. The learned counsel appearing for the petitioner submitted that the submissions made by the learned Special Government Pleader may be recorded and the Writ Petition may be closed.
5. Having regard to the submissions made by the learned counsel on either side, recording the submissions made by the learned Special Government Pleader, the Writ Petition stands closed. No costs.
