This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 18.06.2024, seeking bail in Crime No.77 of 2024 for the alleged offences punishable under Sections 273, 328 of IPC and Section 20(1) of Cigarettes and other Tobacco Products Act, 2003.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the petitioner. He also submitted that the petitioner, who is no way connected with the alleged offence, has been in custody from 18.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that, it is the case, where, the accused was found to be in illegal possession of 138 kilograms of banned tobacco products and the investigation in this case is still pending. 1 / 2 https://www.mhc.tn.gov.in/judis

4. He further submitted that this is the second application for bail filed by the petitioner and his earlier bail application was dismissed only on 01.07.2024 and there is no change in circumstances. Hence, he opposed for granting bail to the petitioner.

5. Taking into consideration the submissions made by the learned Government Advocate (Criminal Side) that there is no change in circumstances and taking note of the quantity of the contraband recovered from the accused, this Court is not inclined to grant bail to the petitioner.
