The petitioner namely Vijayalatha, who was arrested and remanded to judicial custody on 15.06.2023 for the offences punishable under Sections 406, 419, 420 r/w 120(B) IPC in Crime No.99 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated as an accused in Crime No.99 of 2023 for the offences Sections 406, 419, 420 r/w 120(B) IPC. Petitioner is in judicial custody from 15.06.2023. Thus, he prays for grant of bail.

3. The learned Government Advocate (Crl. Side), opposes this petition, on the ground that, defacto complainant invested huge sum in Hijau Associates Private Limited. The said company has not returned the money to the defacto complainant. Thereafter, accused got in touch with the defacto complainant and promised to get money from the company, on commission. Accordingly, defacto complainant paid Rs.25,00,000/- to the accused as commission. Till now, defacto complainant has not received the money from Hijau Associate Private Limited and accused had also not repaid the amount 1/3

Rs.25,00,000/- paid to them. Therefore, he strongly opposed this petition.

4. Considering the nature of the allegations made in the first information report against the petitioner and the fact that petitioner also received money through G-Pay from the defacto complainant and that money is not recovered from the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
