C.M.P.No.13775 of 2022 in C.M.A.SR.No.17940 of 2021 P.T.ASHA, J, This petition is filed to condone the delay of 2030 days in filing the above appeal in C.M.A.SR.No.17940 of 2021.
2. Heard the learned counsel for the petitioner/appellant and Ms.R.Sreevidhya, learned counsel, who takes notice on behalf of the respondent-3.
3. Notice served on the second respondent has been returned with an endorsement "unclaimed". Therefore, the service is deemed to be completed on the second respondent.
4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 2030 days in filing the above appeal in C.M.A.SR.No.17940 of 2021 is condoned.
5. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission. The Registry is also directed to print the name of Ms.R.Sreevidhya, as learned counsel for the Insurance Company, when the matter is listed for admission.
6. The appellant/claimant will not be entitled to claim interest for the period of 2030 days.
