The petitioner namely Manojkumar @ Mano, who was arrested and remanded to judicial custody on 08.06.2023 for the offences punishable under Sections 417, 420 IPC @ 417, 420, 375 r/w 376, 314 IPC in Crime No.1 of 2023 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated as an accused in Crime No.1 of 2023 for the offences Sections 417, 420 IPC @ 417, 420, 375 r/w 376, 314 IPC. He further submitted that, there is a possibility of settlement. Petitioner is in judicial custody from 08.06.2023. Thus, he prays for grant of bail.
3. The learned Additional Public Prosecutor, opposes this petition, on the ground that, defacto complainant's daughter Karpagam was in love with one Manojkumar for the last 4 years. Manojkumar/Petitioner had forcible sexual relationship with defacto complainant's daughter, on the promise of marriage and made her pregnant. Now, he is going to marry one Aruna. On 07.06.2023, a betrothal function was celebrated for the marriage of petitioner and Aruna. After coming to know about this, defacto 1/4
complainant's daughter consumed poison to commit suicide. During medical examination, it was found that, foetus was dead in the womb. The investigation in this case is pending. Therefore, he strongly opposed this petition.
4. Considered the submissions and perused the records.
5. This is a case of having forcible sexual relationship with the victim and making her pregnant. Now, it is seen in the first information report that, petitioner is going to marry one Aruna. In the said circumstances, the submission of the learned counsel for the petitioner that, there is a proposal for settlement between the parties cannot be accepted.
6. Considering the nature and seriousness of the allegations and the fact that, investigation in this case is pending, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 2/4
