ORDER

This Writ Petition has been filed seeking to direct the respondent to settle a sum of Rs.60,627/- payable to the respondent to the petitioner herein from the date of retirement to date of revision of Dearness Allowance with 6% interest by considering the representation of the petitioner dated 28.06.2023. 1/4

It is the case of the writ petitioner that despite the Order passed in G.O.Ms.No.365 dated 08.10.2012, Finance (Pension) Department enhancing the Dearness Allowance from 65% to 72% payable from 01.07.2012, the same has not been revised and paid to the petitioner. Hence, he submitted a representation on 28.06.2023, which is pending without consideration till date. Hence, this writ petition.

3. Heard both sides. The copy of the above referred Government Order is placed on record. On perusal of the same it would indicate that the State Government has sanctioned one additional installment of dearness allowance at 7% to the pensioners/family pensioners of the State with effect from 01.07.2012. Accordingly, the Government had revised the rate of dearness allowance to the State Government Pensioners/family pensioners from 01.07.2012.

4. Such view of the matter, this Court is inclined to direct the respondent to revise the Dearness Allowance as the above referred Government Order and disburse the benefits to the petitioner within a period of three months from the date of receipt of a copy of this Order.
