ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 1st respondent to pass orders on the appeal dated 06.06.2022 preferred by the petitioner against the Award passed by the 2nd respondent vide Award No.Roc.20/2018 (LA) dated 12.04.2022 within a time frame to be fixed by this Court.
3.It is submitted by the learned counsel for petitioner that aggrieved by the award dated 12.04.2022, petitioner preferred an appeal before the 1st respondent on 06.06.2022. Though enquiry was conducted, the appeal is pending for consideration. It is further submitted by the learned counsel for the petitioner that appeal dated 06.06.2022 may be disposed of within a time frame to be fixed by this Court. 2/5
4.At the outset, learned Special Government Pleader for respondents 1 and 2 would submit that they would consider and dispose of the appeal dated 06.06.2022 in accordance with law, within a time frame to be fixed by this Court.
5.It is submitted that Project Director, National Highways Authority of India, Krishnagiri, Near KKC Petrol Bunk, Krishnagiri is necessary party to dispose of this Writ Petition. Hence, Project Director, National Highways Authority of India, Krishnagiri, Near KKC Petrol Bunk, Krishnagiri is suo moto impleaded as 3rd respondent in this writ petition.
6.In view thereof, the writ petition is disposed of with a direction to the 1st respondent to dispose of the appeal filed by the petitioner dated 06.06.2022, after affording reasonable opportunity of hearing to the petitioner, 3rd respondent and any other interested parties/rival claimants, if any, within a period of 12 weeks from the date of uploading of the web copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the appeal and it is open to the 3/5
