PRAYER: This Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents not to harass the petitioner's family without due process of law by considering the representation of the petitioner dated 11.09.2021.

ORDER

This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner.

2. The learned counsel for the petitioner would submit that petitioner's husband is involved in a criminal case in Crime No.271 of 2020 and on the guise of enquiry, and in search of the petitioner's husband, the petitioner has been unnecessarily harassed by the respondent police.

3. The learned Government Advocate (crl.side), would submit that the petitioner's husband is a History Sheeter and he is involved in a criminal case in Crime No.271 of 2020, wherein, he had assaulted the Sub Inspector of Police. For the purpose of search of the petitioner's husband, known places and https://hcservices.ecourts.gov.in/hcservices/

whereabouts were being watched and enquired. In such circumstances, the petitioner was enquired, which cannot be termed as harassment.

4. In view of the said submission, this Court finds that the petitioner's husband is a History Sheeter, and involved in grievous offence of attacking the police personal and hence this Criminal Original Petition is liable to be dismissed.

5. Accordingly, this Criminal Original Petition is dismissed.
