Respondent PRAYER: Criminal Revision Case is filed under Sections 438 & 442 of Bharatiya Nagarik Suraksha Sanhita, 2023, to set aside the order passed in Crl.M.P.No.1696 of 2025 in C.C.No.04 of 2024 in Crime No.436 of 2023 dated 08.04.2025 on the file of the Court of Principal Special Court under EC and NDPS Act, Chennai District and direct the Court of Principal Special Court under EC and NDPS Act, Chennai District to return the vehicle namely Auto registration No.TN-06-Z-1966 to the petitioner.

O R D E R

This Criminal Revision has been filed challenging the order dated 08.04.2025 passed in Crl.MP.No.1696 of 2025 by the Principal Special Court under EC and NDPS Act, Chennai District, thereby dismissing the application seeking return of the property.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned an Auto bearing Registration No. TN-06-Z-1966, which was used by the accused for the transportation of Ganja weighing 50 kilograms. The petitioner has been arrayed as A1 in the case. Pursuant to the registration of the FIR in Crime No.436 of 2023 for the offences punishable under Section 8(c) read with 20(b)(ii)(C), 25, 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985, the said vehicle was seized by the respondent police. Thereafter, the seized vehicle was produced before the Trial Court and the confiscation proceedings have now been initiated against the said vehicle. Therefore, the Trial Court rightly dismissed the petition seeking return of the vehicle.

4. In view of the above, this Court finds no infirmity or

illegality in the order dated 08.04.2025 passed in Crl.MP.No.1696 of 2025 by the Principal Special Court under EC and NDPS Act, Chennai District. Accordingly, this Criminal Revision Case stands dismissed. 19.06.2025 Index : Yes/No : Yes/No Speaking/non-speaking order Lpp To
