ORDER

This Writ Petition has been filed directing the respondents to revise the pay difference in Leave Salary and Gratuity along with the interest at the rate of 10 percent per annum from the date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Court.

The petitioners were appointed in various categories such as Driver, Conductor, Checking Inspector, Tradesman in the 1strespondent-Corporation and after rendering nearly 28 to 30 years of service the 1st petitioner retired from service on 31.01.2025, 2nd Petitioner on 31.10.2024, 3rd,4th,5th,7th,11th Petitioner's on 31.05.2025, 6th Petitioner on 31.05.2024,8th Petitioner on 30.09.2024, 9th Petitioner on 30.04.2025, 10th Petitioner on 31.08.2024, 12th Petitioner on 30.06.2024, 13th Petitioner on 28.02.2025 and 14th Petitioner on 30.11.2024 prior to the 15th wage settlement entered into a settlement under Section 12(3) of the Industrial Disputes Act, 1947, dated 29.05.2025, which was given retrospective effect from 01.09.2023 respectively. As per the said settlement, the petitioner is entitled to the difference in Salary, Surrender leave salary,

Dearness Allowance, Gratuity and pension. However, the said benefits have not been extended to the petitioners. Though the petitioners submitted their representations dated 02.05.2026 to 19.05.2026 in this regard to the respondents, the same has not been considered. Hence, the petitioners have come up with these Writ Petitions.

The learned Standing Counsel for the respondents would fairly submit that they are willing to pay the applicable differential amount of Salary, Surrender leave salary, Dearness Allowance, Gratuity and pension in accordance with the 15thWage Settlement dated 29.05.2025, together with interest at the rate of 6% per annum from the date of their retirement till the date of payment within a period of six weeks from the date of receipt of a copy of this order.

4. Heard the learned counsel appearing for the petitioners and the learned standing counsel appearing for the respondents-Corporation.

5. In view of the above submission of the learned Standing Counsel appearing on behalf of respondents, this Court deems it appropriate to direct the respondents to pay the applicable differential amount of Salary, Surrender leave

salary, Dearness Allowance, Gratuity and pension to the petitioners, in accordance with the 15th Wage Settlement dated 29.05.2025, together with interest at the rate of 6% per annum from the date of their entitlement till the date of payment , within a period of six weeks from the date of receipt of a copy of this order.
