ORDER : The Court Made the following order :- The petitioner seeks anticipatory bail in Crime No.190 of 2018 registered by the respondent police for the offence punishable under Sections 143, 147, 341, 188 of IPC r/w Section 30(2) of Tamil Nadu District Police Prohibitory Act, 1861.

The case of the prosecution as per the de-facto complainant Kanniyappan, Sub-Inspector of Police, working in the respondent police station, is that the petitioner along with 10 unnamed accused and 40 others, without any permission from the Government, formed an unlawful assembly and created law and order problem and thereby, the case was registered against them.

The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and that in order to prevent his democratic functioning, a false complaint has been registered against him. He would submit that the other accused have been granted anticipatory bail by the learned Principal Sessions Judge, Kancheepuram District at Chengalpet.

The learned Additional Public Prosecutor would submit that the offences alleged against the petitioner are all bailable in nature and that there is no apprehension of arrest and if at all the petitioner is apprehension of arrest he could surrender before the concerned Court and obtain regular bail.

5. Taking into consideration the facts of the case and the submissions made by the learned Additional Public Prosecutor that the offence alleged against the petitioner are bailable in nature and there is no apprehension of arrest, this Criminal Original Petition is closed.
