ORDER

Heard Mr.A.Saranraj, the learned counsel appearing for the petitioner, Mr.N.Srinivasan, the learned Additional Government Pleader, who accepts notice for respondents 1 and 2

and Mr.K.T.Devendran, the learned counsel, who accepts notice for the third respondent. Considering the nature of order to be passed herein, this Court is of the view that notice to the fourth respondent could be dispensed with. Accordingly, it is dispensed with.

The grievance of the petitioner, in this case is that, on account of the vacancy arisen to the post of Panchayat Secretary, the District Employment Office, Nagapattinam, sponsored the name of the petitioner to the third respondent, pursuant to which, the third respondent, issued a communication to the petitioner to appear for interview in his Office with all relevant original documents, viz. Education Qualification, Transfer Certificate, Ration Card, etc. Accordingly, the petitioner went to the Office of the third respondent with all required documents and attended the interview successfully and he was under the fond hope that he will get appointment to the aforesaid post.

But to his shock and surprise, he came to know that the fourth respondent is going to be appointed by the third respondent, though the petitioner is eligible for the same. Feeling aggrieved, the petitioner has made a representation, but, his representation has not been considered and the same is pending with the third respondent since 01.06.2018. Therefore, he has come to this Court seeking a direction to dispose of his representation in accordance with law within the time frame as stipulated by this Court.

Considering the limited prayer sought for by the petitioner, in this Writ Petition, this Court is of the view that the same can be disposed of in the absence of counter/reply affidavit and putting notice to the fourth respondent and also hearing him on such representation, if any. Accordingly, this Court disposes of the Writ Petition with a direction to the third respondent to consider and take an informed decision on the representation of the petitioner dated 01.06.2018, within four weeks from the date of receipt of a copy of this order, on its own merit, and if any such decision is going to affect the fourth respondent, in any manner, after putting a notice to the fourth respondent, such decision shall be taken.
