Crl.O.P.No.19117 of 2022 G.K.ILANTHIRAIYAN, J.

The petitioner, who was arrested and remanded to judicial custody on 14.11.2020 for the offences punishable under Sections 342, 366, 506(ii) of IPC r/w Section 5(m) r/w 6 of POCSO Act 2012 in Crime No.14 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner had committed penetrative sexual assault on the victim girl aged about 12 years. Hence, the complaint.

3. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that the victim girl is aged about 12 years. The petitioner is aged about 30 years and he is a married person. The petitioner is neighbour of the victim girl and utilizing the said circumstances, he had committed penetrative sexual assault on the victim girl aged about 12 years. Therefore, the petitioner has committed very serious and heinous offence as against the minor victim girl. Now, the charge sheet has been filed and the same has been taken cognizance in Spl.S.C.No.38 of 2021 and it is pending for trial before the Special Court for Exclusive Trial of Cases under POCSO Act, Villupuram.

4. In view of the same, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed. However, the trial Court is directed to complete the trial within the period of 3 months from the date of receipt of copy of this Order.
