The Writ petition has been filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the 2nd respondent to consider the petitioner's representation (complaint) dated 05.08.2021 and consequently, to conduct the enquiry against the third respondent herein according to law. ORDER

This Writ Petition has been filed to issue a writ of Mandamus directing the 2nd respondent to consider the petitioner's representation (complaint) dated 05.08.2021 and consequently, to conduct the enquiry against the third respondent herein according to law.

2.The learned counsel for the petitioner submits that the petitioner is working as a Marketing Manager, Chennai Grid Foundation Building Limited. At that time, the third respondent was working as a Assistant Engineer in Zone 7, J.J.Nagar, Chennai. He frequently visited the petitioner's sites and moved closely with him. Thereafter, the third respondent told that so many houses are vacant in the Housing Board and introduced the officers of Housing Board to him. Believing the same, the petitioner introduced his brother and relatives and collected a sum of Rs.9,00,000/- and gave to him, after that allotment order with seal of the Tamil Nadu Government Seal cited at Ayapakkam, Chennai was issued. Thereafter, the plots are allotted some other persons.

Thereafter, analyzed the allotment order fount it to be forged and therefore, the petitioner approached the third respondent seeking repayment of the amount but the third respondent failed to repay the amount. Therefore, the representation dated 05.08.2021 gave to the second respondent but the second respondent did not take any action against the third respondent. Hence, the present writ petition filed.

3.The learned Additional Public Prosecutor appearing for the respondent Nos.1 & 2 would submit that the petitioner's representation dated 05.08.2021 received by the second respondent police and CSR No.428 of 2021 assigned, within a period of eight weeks, the representation of the petitioner would be considered and thereafter, appropriate orders would be passed.

4.In view of the above, the second respondent police is directed to consider the representation of the petitioner dated 05.08.2021, within a period of eight weeks, from the date of receipt of a copy of this order and pass appropriate orders in accordance with law.

5.With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
