O R D E R

This Writ Petition has been filed for a direction to the respondent 1 to 3 to consider the online complaint No.2025-6990V0 dated 06.04.2025 made by the petitioner with regard to the illegal and unauthorized constructions being put up by the 4th respondent at No.41/21, Thirupacheeswarar Street, Ayanavaram, Chennai and to take necessary action to remove the same in accordance with law.

2. Mrs.K.Aswini Devi, learned Standing Counsel takes notice for the respondents 1 to 3. Notice to R4 is dispensed with, as no adverse order is going to be passed against her. By consent, the Writ Petition itself is taken up for final disposal at the admission stage. 2/6

It is the case of the petitioner that on earlier occasion, he made several complaints to the respondents 1 to 3 against the 4th respondent for construction of illegal construction without any building approval. Except keeping silence, there was no action taken on his complaints. Thereafter, he sought certain information under the RTI Act, 2005 from the respondents 1 to 3 in respect of the illegal construction of the 4th respondent and there was no reply given within the prescribed time limit. He has also preferred an appeal against the respondents 2 and 3 for their failure to reply to the application. It is further case of the petitioner that he has submitted another online complaint dated 06.04.2025 in the portal of the Chennai Corporation for removal of unauthorized construction. Because of the muscle and money power of the 4th respondent, the respondents 1 to 3 are hesitant to take action against him. Hence, the petitioner is before this Court.

4. Learned Standing Counsel appearing for the respondents 1 to 3 stated that a reasonable time may be granted to the respondents 1 to 3 3/6

for considering and taking action on the complaint dated 06.04.2025 of the petitioner.

Considering the facts and circumstances of the case and taking note of the fact that certain allegations have been made against the respondents 1 to 3 in the petition, this Court, without expressing any opinion on the merits of the matter, directs the respondents 1 to 3 to consider the online complaint dated 06.04.2025 of the petitioner, by giving an opportunity of personal hearing to the petitioner, R4 and other parties concerned and thereafter, take suitable action in accordance with law. Such an exercise shall be carried out within a period of eight weeks from the date of receipt of a copy of this order.
