ORDER
The petitioner, who was arrested and remanded to judicial custody on 18.05.2026 for the offence punishable under Section 318(3) and 318(4) of BNS, 2023 in crime No.11 of 2026 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioner along with others have cheated 37 victims to the tune of Rs.75,00,000/- under the guise of job racketing which led to the registration of an FIR. Hence, the present petition has been filed by the petitioner for seeking bail.
3. The learned counsel appearing for the petitioners submits that the petitioner is an innocent, he has not committed any such offence as alleged by the prosecution and a false case has been foisted against him. He further submits that the petitioner is in judicial custody from 18.05.2026 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there is
specific overt act against the petitioner and the investigation is pending in this case. Hence, he vehemently opposed to grant bail to the petitioners.
5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.Side) and perused the materials available on records.
6. Considering the overall facts and circumstances of the case, the petitioner and other have committed serious offence, the investigation is pending and if the petitioner is released on bail, he will indulge in similar kind of offences. Hence, this Court is not inclined to grant bail to the petitioner.
