ORDER

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 392 of IPC, in Crime No.1577 of 2020, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant is that when he was proceeding in a lorry, the petitioner along other accused overtook the lorry and parked his car in front of the lorry, due to which the defacto complainant got down from his lorry. At that time the petitioner along with other accused had drove away the lorry along with parcel goods. The total value of the lorry is Rs.7,00,000/- and the goods value to the tune of Rs.3,22,869/-. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is in noway connected with the alleged offence and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit https://hcservices.ecourts.gov.in/hcservices/

that the petitioner along with other accused robbed defacto complainant's lorry along with parcel goods. The total value of the lorry is Rs.7,00,000/- and the goods value to the tune of Rs.3,22,869/-. He would further submit that the petitioner is a habitual offender . Hence, he prays for dismissal of this petition.

5. Considering the fact that the petitioner has involved in serious offences and the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner.
