ORDER
(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 397 of IPC, in Crime No.1582 of 2020, seeks anticipatory bail.
2. The case of the prosecution as per the defacto complainant is that when he was proceeding in his vehicle, the petitioner along other accused waylaid him and robbed a sum of Rs.40,000/- and his mobile mobile phone. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is in noway connected with the alleged offence and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the petitioner along with other accused robbed cash worth Rs.40,000/- and mobile phone worth Rs.7,500/- belonging to the defacto complainant. He would further submit that the petitioner is a habitual offender . Hence, he prays for dismissal of this petition. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the fact that the petitioner has involved in serious offences and the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner.
