This petition seeks relaxation of the condition imposed in Para No.11 (iii) by this Court vide order dated 31.10.2023 in Crl.M.P.No.4489 of 2023 in Crl.A.No.345 of 2023, wherein this Court had directed the petitioners to report and sign before the learned Principal Sessions Judge, Chennai, on the first working day of every month at 10.30 a.m., until the disposal of the appeal.
2. The learned Additional Public Prosecutor submitted that the petitioners have been complying with the conditions regularly.
3. The petitioners seek relaxation on the ground that they are the breadwinners of their family and they are unable to travel from Trichy since they are senior citizens.
4. Considering the reasons stated in the petition and the fact that the petitioners have been complying with the conditions regularly, we are Page No.1/4
inclined to modify the condition in Paragraph 11 (iii) in Crl.M.P.No.4489 of 2023 in Crl.A.No.345 of 2023 as follows:
"11.(iii). The first petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m. until the disposal of the Appeal and the petitioners 2 and 3 shall appear before the learned Principal District Judge, Trichy on the first working day of every month at 10.30 a.m. until the disposal of the Appeal and if they are not able to appear before the court concerned on any day, they shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the court concerned on any other day in lieu of the date of their absence, as directed by the court concerned."
The other conditions in Paragraph No.11 of Crl.M.P.No.4489 of 2023 in Crl.A.No.345 of 2023, dated 31.10.2023 shall remain unaltered. Page No.2/4
