Respondent PRAYER: Criminal Revision Case has been filed under Section 438 r/w 442 of BNSS(397 r/w 401 of Cr.P.C.), praying to call for the records pertaining to the case in MC.no.42 of 2022 and set aside the impugned order of granting maintenance dated 28.01.2025 passed by the learned Family Court Judge, Salem in MC.No.42 of 2022.
For Petitioner :

ORDER
This criminal revision case has been filed against the order dated 28.01.2025 passed in MC.No.42 of 2022 on the file of the learned 1/4
Family Court Judge, Salem, thereby the petitioner was directed to pay Rs.6,000/- per month as interim maintenance to the respondent. 2.
Heard, the learned counsel appearing for the petitioner and perused, all the materials placed before this Court. 3.
The respondent married the petitioner on 10.02.1980 and gave birth to a female child. After the marriage of that daughter, the petitioner failed to maintain the respondent due to misunderstanding for the reason the petitioner has second wife and gave birth to two children through the second wife. Therefore, the respondent was driven out from the matrimonial home and she is living separately and as such, she was not able to maintain herself. Hence, she filed petition for maintenance. After full-fledged trial, the trial court awarded compensation of Rs.6,000/- payable by the petitioner in favour of the respondent as monthly maintenance. The income and the other 2/4
factual grounds raised in the petition filed by the respondent seeking maintainance were not denied. That apart, the income of the petitioner was not disputed and as such, the trial court, after full-fledged trial, ordered maintenance of only Rs.6,000/- per month payable by the petitioner in favour of the respondent herein. It is a very meagre amount in the present days. Therefore, this Court finds no infirmity or illegality in the impugned order. As such, this criminal revision case is liable to be dismissed. 4.
Accordingly, this criminal revision case is dismissed. 18.06.2025 Index:Yes/No Speaking/Non speaking order lok 3/4
