The plaintiff has appealed against the decree granted for 1/4th share, as against his claim for 1⁄2 share in the suit properties.
2. Mr.B.K.Sreenivasan, learned counsel appearing for the appellant would apprehend that the defendant may seek a final decree.
3. A perusal of the decree shows that there is no decree granted declaring the shares of the defendant. Hence, there cannot be a stay of further proceedings pursuant to the decree as it stands today.
4. Hence, this application is dismissed as unnecessary, with liberty to the petitioner to apply if in case the respondent pay Court fee and seek a decree in their favour.
