PRAYER: Original Petition filed for grant of Succession Certificate under Section 372 of the Indian Succession Act, 1925 read with Order XXV Rule 6 of O.S.Rules.

ORDER

The petitioner seeks Succession Certificate in respect of the securities held by Late Tarun George, who died intestate on 24.04.2024 along with his wife and two sons in a road accident. The petitioner is father of the deceased. The Petitioner and his wife are alone the surviving legal heirs of the deceased.

2. The petitioner has been examined as PW1. He has produced the death certificates of his son, daughter-in-law and two grand children as 1/4

Ex.P1, Ex.P2, Ex.P3 and Ex.P4 and the legal heirship certificate of the Late Tarun George as Ex.P5. A perusal of Ex.P5 shows that the petitioner and his wife alone are the surviving legal heirs of the Late Tarun George. A paper publication has been made wherein it is stated that the petitioner alone is the legal heir of late.Tarun George and no objections have been received.

3. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioner, to collect the debt and receive the interest in respect of the securities mentioned in the schedule to the petition.
