PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to forbear the respondents 1 to 3 from cancelling the house tax assessment number 12799 to 12802 on the file of the 3rd respondent without following the procedure contemplated under Act.

ORDER

Heard the learned counsel for the petitioner, learned Special Government Pleader for the respondents 1 to 3 and perused the materials available on record.

2. The petitioner has prayed for issuance of a writ of mandamus, to forbear the respondents 1 to 3 from cancelling the house tax assessment number 12799 to 12802 on the file of the 3rd respondent.

3. The learned Special Government Pleader on instructions submitted that even before filing of this writ petition, the property tax assessment was cancelled by the third respondent. The cancellation order is produced before this court for perusal.

4. In the light of the above facts, the writ petition is dismissed as having become infructuous with liberty to the petitioner to challenge the rejection order. No costs.
