This Criminal Original Petition has been filed to set aside the order dated 01.07.2022 passed in Crl.M.P.No.1477 of 2022 on the file of the V Metropolitan Magistrate Court- Egmore, Chennai.
2. This Court on 12.09.2022 referred this matter to Mediation and Conciliation Centre, for mediating the dispute between the parties.
3. Petitioner is the wife of 2nd respondent/complainant in private complaint in Crl.M.P.No.1477 of 2022. Petitioner was represented by her father and Power Agent namely D.Padmanaban. In the Mediation, parties arrived at a settlement and Settlement Agreement was entered into between the parties. As per the Settlement Agreement, petitioner is withdrawing Crl.O.P.No.19453 of 2022. One of the terms of the agreement is that 2nd respondent undertakes to withdraw the criminal complaint pending before the K4, Police Station sent vide Crl.M.P.No.1477 of 2022 on the file of V Metropolitan Magistrate Court, Egmore which is subject matter of this petition.

4. The petitioner and the 2nd respondent are wife and husband. Due to marital discard, 2nd respondent gave a private complaint. It appears that FIR is not registered on the basis of the complaint forwarded under Section 156(3) Cr.P.C. In the light of the settlement reached between the parties, this Court disposes this petition, giving direction to the petitioner to withdraw Crl.M.P.No.1477 of 2022 pending on the file of the V Metropolitan Magistrate Court, Egmore. The learned Magistrate shall recall the order directing the registration of FIR. The Settlement Agreement shall form part and parcel of this order.
5. Accordingly, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. 09.03.2023 Internet :Yes Index :Yes/No gd 3/4
