O R D E R
The present writ petition has been filed to call for the records relating to the impugned order dated 15.07.2023 passed by the first respondent in Na.Ka.No.D3/1978/2022 quash the same as arbitrary, illegal and without jurisdiction and consequently direct respondents 1 to 3 to restore the petitioner name in patta No.1217 in respect of subdivision SF.No.108/3 corresponding to SF.No.108/2C3 Sathuvachari Village, Vellore District. 2/5
2. The learned counsel for the petitioner states that the patta originally stood in the name of petitioner, but was subsequently transferred in the name of respondents 4 to 9. Petitioner was not even put on notice before such transfer was effected. The learned counsel for the petitioner submits that the impugned proceedings suffers gross violation of principles of natural justice.
3. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that notice will be issued to the petitioner as well as to the respondents 4 to 9 and other interested parties, if any, after affording reasonable opportunity of hearing and pass orders afresh.
4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 to 3 and the learned counsel appearing for the respondents 5 to 9. Since, no adverse order being passed, notice to the 4th respondent is dispensed with.
5. In view of the submissions so made by the learned counsel appearing for the respondents 1 to 3, the officials respondents are directed to issue notice to the respondents 4 to 9 and to any other interested parties and conduct enquiry on merits and in accordance with law and pass orders 3/5
within a period of sixteen weeks from the date of receipt of a copy of this order.
6. With the above direction, this writ petition is disposed of. No costs.
