O R D E R

This petition has been filed to direct the 2nd respondent herein to take on file of the petitioner's statement sent by way of representations dated 29.08.2016 and 12.09.2016 and to proceed the investigation and case in Crime No.265 of 2016 on the file of the 2nd respondent herein in further, in accordance with the law by taking note of the aforesaid representations.

2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.

3. On the complaint lodged by Chockalingam, the respondent police have registered a case in Crime No.265 of 2016 on 29.08.2016 for the offence u/s. 279 & 304 (A) IPC against the petitioner herein, who is said to be the driver of the transport corporation bus which was https://hcservices.ecourts.gov.in/hcservices/

allegedly involved in the accident. It is the case of the petitioner that, while the petitioner was on the wheels the deceased came in a two wheeler and had hit the school bus which was coming in the opposite side and thereafter only they had bumped on the bus of the petitioner therefore the petitioner is not responsible for the accident.

4. In this regard, the petitioner has given a representation dated 29.08.2016 to the police and has now come up with an application to issue a direction to police to consider his representation.

5. In the considered opinion of this Court, such directions cannot be issued u/s.482 Cr.P.C. This court cannot interfere and direct the police to investigate the case in a particular manner. However, the respondent police are directed to conduct a thorough investigation and find out if there is any truth in the version of the petitioner about the manner in which the accident had taken place.
