A No.4017 of 2021 in CS SR. No.88952 of 2021 ABDUL QUDDHOSE, J.

The suit has been filed for recovery of money on account of nonpayment of value of the goods supplied by the plaintiff to the fifth defendant.

2. According to the plaintiff, the remaining defendants are the beneficiaries of the goods supplied by the plaintiff based on the order placed by the fifth defendant.

3. It is the case of the plaintiff that all the defendants are jointly and severally liable to pay the suit claim. According to the plaintiff, order was placed for supplying the goods only at Chennai, within the jurisdiction of this Court. It is also the case of the plaintiff that the major part of the cause of action arose only within the jurisdiction of this Court. However, the defendants No.3,6,7 and 8 are located outside the jurisdiction of this Court. Hence, the plaintiff has sought for leave to sue.

4. This Court is satisfied with the reasons stated in the affidavit, filed in support of this application.

5. Accordingly, leave to sue is granted as prayed for. Registry is directed to number the suit, if it is otherwise in order. 09.11.2021 sr/rgi http://www.judis.nic.in
