Prayer: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of mandamus, to direct the respondents to consider the petitioner's representation dated 21.10.2024 and thereby direct the 1st and 2nd respondents to issue Patta in respect of the property situated at Anumathapuram Village, Irudhukottai Post, Denkanikottai Taluk, Krishnagiri District comprised in S.No.313/6 to an extent of 4.69 acres in the name of the petitioner within a stipulated period of time. ORDER
The present writ petition is filed praying for a mandamus to direct the respondents to consider the petitioner's representation dated 21.10.2024 and to issue patta to the petitioner, in respect of the property comprised in S.No.313/6, measuring an extent of 4.69 acres, situate at Anumathapuram Village, Irudhukottai Post, Denkanikottai Taluk, Krishnagiri District. The learned Counsel for the petitioner would submit that the subject property comprised in S.No.313/6, measuring an extent of 4.69 acres,
situated at Anumathapuram Village, Irudhukottai Post, Denkanikottai Taluk, Krishnagiri District, was in possession and enjoyment of one Vediappan, father-in-law of the petitioner. After the demise of said Vediappan, petitioner as a legal heir, succeeded to the subject property. Thereafter, petitioner constructed a house and obtained electricity service connection and has been residing in the subject property for the past 15 years. Therefore, the petitioner has submitted representation to the respondents dated 21.10.2024, seeking for an issuance of Patta in her name and the same is yet to be considered by the respondents. Hence praying for a mandamus, the petitioner has come before this Court.
At the outset, it is submitted by the learned Special Government Pleader, that the subject lands are Government 'Podugal' lands and therefore, the petitioner is an encroacher. However, he would submit that the petitioner's representation will be considered in accordance with law. In view thereof, the Writ Petition is disposed of with a direction to the respondents to conduct an enquiry by considering the petitioner's representation dated 21.10.2024 on its own merits and in accordance with
law and during enquiry, if it is found that the petitioner in an encroacher of Government land, then appropriate measures shall be taken to evict the petitioner from the occupation of Government land, after following due process of law. No costs.
