Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relevant to the proceedings in NaKa.A3/603/2020 dated 08.01.2021 passed by the 2nd respondent and quash the same as illegal, improper, 1/4

unreasonable, arbitrary and against the principles of natural justice and thereby direct the respondents 1 to 3 to cancel the settlement deed in Document Nos.6805 and 6806 of 2014 dated 10.09.2014 on the file of 4th respondent.

ORDER

This petition is filed by a senior citizen, who has approached this Court alleging that his Application to the third respondent for cancellation of a settlement deed dated 10.09.2014 was not considered. 2.The quintessence of the contention of the petitioner is that the fifth respondent has duped the petitioner and obtained a settlement deed. According to the petitioner, the fifth respondent claims himself to be the step-son of the petitioner.

3.Mr.C.Kathiresan, learned Special Government Pleader takes notice for the respondents 1 to 4.

4.The nature of allegation made by the petitioner indicates that for obtaining appropriate remedy, he may have to either approach the Registration Authority under Section 77A of the Registration Act or the civil Court.

5.This Court also finds that a representation dated 08.01.2021 has been given by the petitioner to the Sub Registrar concerned. 6.The petitioner is now required to prefer a fresh complaint to the Registration Authority with all material particulars, if she is so desirous. 7.The Writ Petition is disposed of accordingly. No costs. W.M.P.No.20542 of 2023 is allowed and W.M.P.Nos.20544 and 20545 are closed.
