The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 341, 342, 294(b), 324, 506(ii), and 307 IPC in Crime No.405 of 2022, seek anticipatory bail.
2. The case of the prosecution is that while the defacto complainant's husband returning to home after dropping his son in school, the petitioners and two others attacked him with stick and knife, due to which, the he sustained injuries. Hence the complaint.
3. The learned counsel appearing for the petitioners would submit that due to previous enmity, the defacto complainant lodged false complaint against the petitioners and the petitioners are innocent persons. Therefore, he prays to grant anticipatory bail to the petitioners.
4. The learned Additional Public Prosecutor would submit that the petitioners attacked the defacto complainant's husband with stick and knife. Due to which, he sustained injuries. He would further submit that the injured still in hospital. Therefore, he vehemently opposed to grant anticipatory bail to the petitioners.
5. Considering the above facts and circumstances of the case and also taking note of the fact that the injured still taking treatment in hospital and custodial interrogation of the petitioners is required in this case. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
