This petition has been filed to modify the condition imposed on the petitioner in Crl.O.P.No. 17200 of 2022 dated 22.07.2022 that "the petitioner shall deposit a sum of Rs.4,00,000/- (Rupees Four Lakhs only) to the credit of Crime No.322 of 2022 before the concerned Magistrate within a period of four weeks from the date on which the order copy is made ready.

2. The learned counsel for the petitioner submitted that the petitioners are landlord and the defacto complainant is the tenant. He further submitted that the petitioners do not have any financial capacity to deposit a sum of Rs.4,00,000/-. Hence, he prays for modification of the condition.

3. It is seen that all the four accused are family members. There is a owner and tenant issue. Therefore, this Court is inclined to modify the condition to the effect that "the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.II, Tambaram, on condition that the petitioners shall execute a separate bond for a sum of Rs.10,000/- (Rupees Ten https://www.mhc.tn.gov.in/judis

Lpp Thousand only) each, with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed". The other conditions imposed by this Court vide its order dated 22.07.2022 shall remain intact.
